E-discovery will slash compliance costs

By the end of 2012, organisations that fully document their search processes in e-discovery will save 25% on their collection processes, according to Gartner.

“Addressing the ongoing challenge of the IT perspective of litigation management demands both that the technologies be acquired and that procedures for using them be established,” said Whit Andrews, vice president and distinguished analyst. “Companies need to own the products that will be necessary for them to address litigation and understand that those products will not have the same positive impact unless they are supported by repeatable, effective, systemic processes for lawyers and IT to follow.”

“Full service providers (ie: ones that offer data restoration, collection, processing, hosted review, production, and consulting services) and service providers that have a unique core competency (ie: they specialize in class action or joint defense matters) are very well positioned. More often than not, customers need technology and some hand-holding / an expert. A legal service provider that can help with electronic discovery with project management and consulting through production is more valuable than simple data processing – especially if the consulting skills are particular to a type of matter.” Read complete post here

CW: IT totally unprepared for impact of FRCP amendments

Computerworld surveys the IT response to the amendments to the Federal Rules of Civil Procedure (FRCP), which became effective today.

About 42% of the 170 IT managers and staffers surveyed said they did not know the status of their company’s preparation for the new rules, while 32% said their company was not at all prepared.

John Bace, analyst from Gartner, blames the GC for not proactively counseling IT.

Gartner, the respected, fairly conservative IT advisory service, is very concerned about a blackberry blackout and demands the proposed workarounds.

Me too. The fire alarm here at the charming Riverside Hotel rang and rang this morning. I not only trundled down 11 flights of stairs with my trusty blackberry, I took my charger along with my cell, laptop and outfit for tomorrow’s speaking engagement for American Document Management. Glad it wasn’t a real fire. Interesting what turns out to be important…
